YESTERDAY, nagputol ng linya ng tubig ang acer sa phase 5. not sure kung meron din naputulan sa ibang phase.
sa phase 5, mayroong naputulan pero bayad naman sa tubig. dun sa maintenance o subdivision dues sila hindi bayad.
masyado yatang nagiging adelantado ang mga taga acer. ura-urada nagpuputol.
tumawag ako sa acer pero di sumasagot si engineer anico, johnny corpus at si jonel. nagri-ring ng matagal tapos sa kaka try ko nag-off na cp.
pinuntahan ko ang clubhouse sinabi kay thadeus ang concern ko pero sabi niya ganun daw talaga ang policy. sabi ko inform ko siya kasi pinapunta ako ng hlurb dun para makipag-usap pero , wala ang mga boss di rin naman nag reply ang mga boss.
sabi ng hlurb, 'di raw dapat nagpuputol ang acer dahil ang tubig ay necessity
at kasama sa kontrata. kung may problema sa dues o ano pa man raw dapat madamay ang tubig.
ano sa palagay ninyo ang tama at dapat gawin para mai-korek itong tila maling asal ng acer.

Sir Chairman Ed Comia, today 3pm, may meeting tayo ng Fed, we expect na darating all phases, importante na makapag disscuss tayo ng gagawin nating move, let us all show acer na we condemned those actions that they are doing....

Dagdag ko e2 ayon sa HLURB ang may rights mag exact ng toll/levy/dues ay ang HOA through its boad of trustees/directors. Kung boad of trustees / directors dapat may resolution regarding the dues/levies.

tama ka sir, yan din ang ginamit ko argument dun sa sulat na finile namin sa HLURB last monday. hopefully next week ay may sagot na ang HLURB para sa meeting w/the officials of acerhomes. just in case it will be the landmark decision. iam also confident that the decision wll be favorable to the residents/homeowners of eastwood.
dun sa letter/complaint ang mga pwedeng masagot ay:
1. dapat bang putulan ng tubig ang mga residenteng bayad ang bill pero may utang sa subdivision dues.
2. dapat na bang magbayad ng dues ang mga taga phase-5;
3. sino at paano ba dapat o tamang paraan sa paniningil ng subdivision dues.
i'll let you know anuman ang maging desisyon, sana soon.

magandang araw po sa inyong lahat.
pasensiya na kung ngayon lang po ako makapagbibigay ng update tungkol sa pamumutol ng linya ng tubig dahil sumailalim po ako sa operation nitong december.
anyway, nakatanggap na po kami ng sulat mula sa hlurb at nasa legal department na ang reklamo. hintay na lang namin ang date ng hearing? together with the offficers of acerhomes.

i ALSO BELIEVED THAT THIS IS A HLURB CASE...ABANGAN SUSUNOD NA LEGAL REACTION OF THE HLURB...MEANWHILE I SUGGEST THAT A COMPLAINT LETTER BE FORMALLY FILED BY THE AFFECTED CONCERNS FOR THE RECORD...THEN A STRONG LETTER OF PROTESTS TO THIS ACTION OF ADC SHALL BE PREPARED BY THE FED SIGNED BY ALL OFFICERS AND BOT.

E2 NA PO ANG UPDATE. kanina jan 10, 2009 aroud 10 am, pumunta sa hlurb to chek yung complaint (illegal water disconnection).
nabasa ko ang draft ng sagot ng legal department sa querries ng taga phase 5.
ang gist ay ito... iligal na putulan ang tubig kung subdivision dues ang problema. "necessity " raw kasi ang tubig. may ibang paraan daw para makasingil sila ng subdivision dues.
collection ng subdivision dues... still illegal ang ginagawa ng developer. i will elaborate dis one once makuha ko ang hard copy.
i was advised by the legal department to make another letter since may question ako sa ibang portion nung decision.

This refers to yourletter seeking clarification whether it legal on the part of the developer to cut the water lines of some residentsfor non-payment of maintenance and/or subdivision dues despite the fact that they religiously pay their water bills.
Relative thereto, our answer is in the negative. In an analogous issue, we pertinently opined that:
"Water is basic necessity of every household and should not be coerced in paying association dues by disconnecting his water supply, since there is a legal remedy on how to collect association dues from unit owners, such as filing of case against non-paying members. To deprive unit owner of water supply for non-payment association is illegal."
Besides, the developer is mandated by law to maintain the subdivision roads and open spaces until the same are turned over to the local government unit and has no azuthority to collect maintenance dues from the homeowners. Only a properly organized homeowners association, with the consent of the lot or unit buyers actually residing in the subdivision may collect fees for common comfort, security and sanitation.
